Why Application Beats Memorization
The SAFE test does not reward rote recall — it rewards applied knowledge. Instead of memorizing hundreds of isolated definitions, you need to know which rule applies in which borrower scenario: when a Loan Estimate is due, which law a practice violates, or what a loan originator may and may not say. Candidates who study with scenarios — not just flashcards — consistently understand the material more deeply. That is also why the exam is scored at 75%: you do not need perfection, you need command of the highest-weight content.
The Big Picture: 60/20/20 Plus UST
Before the chapter list, internalize the weighting: the national portion of the test is roughly 60% federal mortgage law, 20% general mortgage knowledge, and 20% ethics. If your state requires Uniform State Content, 13–25 additional questions cover your state's licensing law. Federal mortgage law is the biggest bucket by far — that is where most of your study hours should go.

- 3. Federal Mortgage Law — FCRA & Privacy: credit reports, Regulation V, and GLBA privacy safeguards.
- 4. Federal Mortgage Law — SAFE Act & Licensing: NMLS, who must be licensed, and the licensing process itself.
- 5. Federal Mortgage Law — HMDA & Consumer Protection: reporting, CFPB oversight, and UDAAP.
- 6. General Mortgage Knowledge — Conventional Loan Products: conforming loans, PMI, and fixed vs. adjustable structures.

High-Yield Rules to Know Cold
While all 14 chapters are fair game, these specific rules appear disproportionately often:
- TRID timelines: the Loan Estimate must be delivered within 3 business days of a complete application; the Closing Disclosure must be delivered at least 3 business days before closing.
- Fee tolerances: certain closing costs carry a 0% tolerance and others allow up to 10%; the exam loves asking which bucket a fee falls in.
- Rescission: 3 business days to rescind a refinance of a primary residence — but not a purchase.
- APR vs. interest rate: APR includes points and fees, so it is almost always higher than the note rate.
- PMI: conventional loans above 80% loan-to-value typically require private mortgage insurance.
- FHA: 3.5% down payment with mortgage insurance; VA: 0 down with no PMI (a funding fee applies); USDA: 0 down with a guarantee fee in eligible areas.
- ECOA protected bases: race, color, religion, national origin, sex, marital status, age, and reliance on public assistance income.
- Qualified Mortgage: the ability-to-repay rule and the 3% cap on points and fees are core underwriting concepts.
The Laws Behind the Scenarios
Federal mortgage law questions test whether you can keep the statutes straight. The high-yield map:
- RESPA governs settlement processes and disclosures — including TRID's Loan Estimate and Closing Disclosure, plus the ban on kickbacks for settlement services.
- TILA (Regulation Z) governs credit terms — APR, finance charges, and the right of rescission.
- ECOA (Regulation B) prohibits credit discrimination and requires adverse action notices.
- FCRA (Regulation V) governs credit report accuracy and how information is used.
- HMDA (Regulation C) requires lenders to report mortgage data; GLBA adds privacy obligations.
- The SAFE Act is the licensing framework itself — the reason you are taking this test through NMLS.
Ethics: Not an Afterthought
Ethics is worth roughly 20% of the national portion — the same weight as all of general mortgage knowledge combined — yet it is the area candidates study least. The exam does not test whether you are a good person; it tests whether you can recognize prohibited conduct in a scenario. Know the high-yield violations cold: mortgage fraud and misrepresentation, identity theft red flags, churning and abusive refinancing, misleading advertising, and steering borrowers to loans they do not qualify for. Also know the positive duties: accurate disclosures, honest communication with borrowers and lenders, and full compliance with the SAFE Act's licensing requirements. When a scenario feels like a conflict between "close the loan" and "follow the rule," the exam's answer is always the rule.
